Global-e

Globale U.K. Limited ("Global-e") is our international sales facilitation and fulfilment partner. Global-e will be the seller on record for all contracts (made with you) for the purchase and sale of SimplyBe products from the Website. Global-e will take your payment and be responsible for ensuring the approved carriers deliver your orders. ACCEPTANCE OF YOUR ORDER

DELAYS

Where the supply of your product(s) or service(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

Neither we nor Global-e shall incur any liability in such circumstances.

You warrant that you are authorised to use any credit cards, PayPal account, debit card or other payment options you are using to pay for your order and you have sufficient funds. When you place an order you represent and agree that the goods you order are retail purchases and not for commercial resale.

If there are any changes to the personal information you supply, including, but not limited to, your name or address, it is your responsibility to let Global-e know as soon as possible to avoid misdirected orders.

Limits On Purchases

We do not authorise the purchase of our merchandise for resale purposes. To enforce this policy, we may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer, the same credit card, and/or orders that use the same billing and/or shipping address. PROMOTION CODES

The following Conditions apply for the redemption of any promotional codes we may offer to you:

Delivery charges and timescales vary depending on the type of products ordered, the service you select and the delivery address. You’ll find full details of delivery charges at simplybe.com. Please note that certain products and services may be subject to alternative delivery charges, restrictions and/or timescales. In particular:

  1. Delivery will be to an international address;
  2. If delivery cannot be made to a customer due to the customer not being present at the address or at the time allotted by the carrier or if a customer refuses to accept the products, Global-e reserves the right to deduct the cost for returning products to the returns centre from the customer’s refund for the order.

All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order. Neither we nor Global-e shall be under any liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.

DELIVERY SERVICE

Two choices of delivery service are offered for your purchase sent via Global-e. For full details of delivery costs and options, please see the Delivery section of the website.

It takes approximately 2 days for your order to be processed and dispatched from our warehouse.

The stated delivery period within which you will receive your order is approximate.

Goods will be sent to the shipping address you specify in your order and this cannot be changed once your order is processed.

DELIVERY TO A DIFFERENT ADDRESS

You may send your order to a different address other than your billing address if you wish. If you want to take advantage of this facility, simply click “Add new address” on the checkout page and follow the instructions given. Please note you can only send items from a single order to one address, whether it is the billing address or an alternate. Multi address delivery for single orders is not available.

RECEIVED ORDERS

If you haven’t received an item that appears on your packing slip(s), please inquire about it as soon as possible via service@Global-e.com . The assumption is that all the items have been successfully delivered unless we hear from you within thirty (30) days of the original order date.

Returns

If for any reason you want to send back something you’ve bought, you can make use of our simple returns service; In order to return products, please access the Returns Portal via https://web.global-e.com/Returns/portal within 30 days from the date the order was placed and ship the return products promptly. Simply return it in “as new” undamaged condition (with all tags attached) within 30-days of receipt. Global-e will not accept any return product that was used or damaged by you or where the original packaging of such product has been opened.

Upon receipt of the returned product, and confirmation that it has been returned in accordance with the applicable requirements, Global-e will reimburse you for the actual paid price of the returned product. The Returns Policy applies to all customers. This policy does not apply to faulty products.
It is in addition to, and does not affect, the separate legal right of cancellation which is available only to EU Consumers in some circumstances as explained below.

If you have paid any import related charges (Import Charges) in connection with your order (either pre-paid at checkout or paid upon receipt of the order directly to the applicable authority), you acknowledge that (a) you must seek reimbursement directly from the applicable authority in your country, (b) it will be your sole responsibility to claim such Import Charges back from the applicable authority in your country, and (c) Global-e cannot guarantee that such claim will be successful. If you have pre-paid Import Charges through at Checkout, upon your written request reasonable efforts will be made to assist you in obtaining reimbursement of such Import Charges.

Any Delivery Costs paid in connection with the Order are non-reimbursable or refundable. Moreover, any delivery and clearance costs incurred by you when returning Merchandise are non-reimbursable or refundable. Return deliveries are at your risk and we therefore advise you to use a courier service offering a tracking number, and to take out adequate insurance to cover the cost of the goods in transit.

RETURNS POLICY FOR FAULTY MERCHANDISE

If any product you order is damaged or faulty when delivered to you or has developed a fault, you may have one or more legal remedies available to you, depending on when you inform of the problem, in accordance with your legal rights. If you believe product was delivered damaged or faulty or has developed a fault, you should inform us as soon as possible, preferably with photographic evidence via service@Global-e.com, giving your name, address and order reference. Nothing in this section affects your legal rights.

Refunds

OUR GOODWILL POLICY

Our “goodwill” refund policy is offered when goods are returned with a valid parcel summary document within 30 days of receipt. Our goodwill policy applies where there is no statutory right to a refund or exchange under the Regulations or otherwise. For a refund or exchange under our goodwill policy, items must be unused, returned in the original packaging and in a re-saleable condition.

EXCLUSIONS FROM THE GOODWILL POLICY

The following items are excluded from our “goodwill” returns policy:

Earrings, underwear with the hygiene seal removed, swimwear with the hygiene seal removed. These products can only be returned in accordance with your statutory rights (for example, if they are not fit for purpose or not as described).

Some of these items may have their own terms and conditions which will be provided to you at the time of purchase.

PRODUCTS LOST OR DAMAGED IN TRANSIT

If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.

DAMAGED OR INCORRECTLY SUPPLIED PRODUCTS

You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (by email only) within a reasonable period of time. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied. We may offer you a replacement product and any refunds given by us will be made to the same method by which payment was made when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return.

YOUR STATUTORY RIGHTS

In addition to our goodwill policy, you also have statutory rights. In addition to the cancellation rights noted above, these include that the goods you purchase are of satisfactory quality, fit for purpose and as described. Within 30 days of the delivery, you may exercise the right to a refund if the product purchased is not of satisfactory quality, fit for purpose or as described. After the 30 day period, but within six months of the date of delivery and where the product is faulty, you are entitled to a repair or replacement or where that is not possible, or the repair/ replacement does not resolve the fault, a refund. After six months of the date of delivery, similar rights exist, but only if you can prove that the fault was present at the point of delivery.

Cancellation

We will do what we can to accommodate your request, but please note that order fulfilment systems are designed to get orders on their way quickly and efficiently. Therefore, we cannot change or cancel an order once it has entered the fulfilment process.

If your cancellation or change request is received after the goods have entered the fulfilment process, they will be shipped and charged.

Please note: If you cancel an item that qualified you for a promotion or special discount, you may no longer receive that discount or promotion.

YOUR RIGHT TO CANCEL (E.U. COUNTRIES ONLY)

If you are contracting as an EU consumer online, you have the right to cancel (under the Consumer Rights Directive 2011/83 as implemented in the applicable EU member state (“CRD”)), all or part of your contract at any time up to 14 calendar days after the day on which you receive the goods you ordered. Any paid delivery charge will be included in your refund once all (not part) of your order which you wish to return has been received. Please note the delivery charge refund will be to the value of standard delivery. Global-e will process your refund with 14 days of receipt of the products, to the specified address. You must take reasonable care of the goods while in your possession and they must be returned (undamaged) before a refund can be issued. If you wish to cancel (or are considering cancelling) a product you have ordered, please be aware of the following terms that apply:

Other cancelled products: If you want to cancel products that are not damaged or incorrectly supplied, then you must inform us of this within 14 calendar days the day after you receive the goods in accordance with the CRD or otherwise as soon as possible. You must take reasonable care of the products that you wish to cancel. Products should be returned undamaged, as new, in or with their original packaging (with all tags attached).

RETURNING GOODS

You will need to send back the goods or hand them over (undamaged with all tags attached) at: NORSK- Global-e UK Hub 96A Beverly Road, East Midlands Airport, Castle Donington, Derby, UK DE74 2SA unless a different address is provided to you, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of the contract. The deadline is met if you send back the goods before the period of 14 days has expired.

PAYMENT

You may pay with the payment methods specified at Checkout. The availability of such payment methods is dependent on your geographical location. CURRENCY

The price of products is calculated according to the rate of exchange between the base currency on the Website and the local currency of the destination country at the time you place your order. Global-e reserve the right to update such exchange rates regularly, and you acknowledge that such updates may affect product pricing on the Website. You will be charged according to the applicable exchange rate at the time you place your order via the Website.

Customs Duties and Taxes

For certain shipping destination countries and/or products, you may be offered the option to pre-pay applicable taxes, which will then be calculated and included in the final price when you place an order through the Website. Global-e may contract with a local licensed customs broker in your country, in which case, by placing an order through the Website, you authorise the applicable customs broker to act as your agent to: (a) conduct transactions with the local customs authority, (b) execute related documents on your behalf in connection with the import of products in your order, (c) facilitate your payment of applicable taxes; and (d) if applicable, return such products to SimplyBe™ (subject to these Terms and Conditions) and (if applicable) handle the associated reimbursement claim for taxes paid. You acknowledge that, in the case of a return of products under the Terms and Conditions below, if Global-e are able to obtain on your behalf reimbursement of taxes paid on orders, any such reimbursement will be paid by the applicable tax authority to the customs broker, and then Global-e will reimburse such amounts directly to you if and to the extent, and only after, such amounts were received from the customs broker.

Important Conditions

Global-e reserve the right to terminate the agreement with you and suspend or terminate your access to order from the Website without notice to you:

  1. if there are grounds for suspecting you committed or are about to commit, or are connected to, fraudulent or illegal activity or

When you make a subsequent card payment to purchase products from us, we will use your personal data and card information to process the order. Global-E, our payment provider, will take your card payment and send your personal data to their card payment and banking providers to ensure that you have sufficient funds to cover the value of the transaction. We will use your personal data to administer and to operate your personal account as set out below. We will collect and use the contact details that you provide to us to communicate with you about your account and in relation to the products and services we provide to you.

DELIVERING YOUR GOODS – SHARING YOUR DATA

We will use your personal contact details such as name, postal address, phone number and email address that you provide to us in respect of delivering products or services to you. We use your customer account and contact details to verify any returns and refunds that we process. Global-E process all payments in line with their obligations under the PCI-DSS regulations and will encrypt the payment details before sending to their payment and banking provider.

From time to time, we employ different market research agencies, who act on our behalf, to contact our customers with the aim of getting a more detailed understanding of what our customers think about our products and services. We may also share more personal data about your shopping habits, including the size and type of products that you have purchased if this is relevant to the market research.
